Agreement Overview

These Terms and Conditions ("Terms") govern your access to and use of the CA Auto InsightReports Services (collectively, the "Services"). CA Auto Insight Reports and any of its affiliates ("CA Auto Insight Reports", "we", "us", and "our") provide you with access to and use of each of the Services, subject to your acceptance of these Terms.

The term "use" (and "using") when used in respect of the Services means access or use. By using any CA Auto Insight Reports Service, you agree to be bound by these Terms and Conditions and our Privacy Policy, available online at [link to our Privacy Policy here] (the "Privacy Policy"), without limitation or qualification.

If you do not agree to be bound by these Terms and our Privacy Policy, or are not capable of agreeing to them, you must not use any of the CA Auto Insight Reports Services.

Parties to this Agreement

These Terms and Conditions form a legal agreement between:

  • CA Auto Insight Reports and you individually, if you are agreeing to these Terms in your own capacity; or
  • CA Auto Insight Reports and the entity on whose behalf you act, if you are authorized to use the Services on behalf of such entity.

Your Acceptance and Warranties

By indicating your acceptance (by clicking on the appropriate button) or by using any of the CA Auto Insight Reports Services or content, you warrant that:

  • You have reached the age of majority in your jurisdiction of residence;
  • You possess the legal authority to create a binding legal obligation on your own behalf or on behalf of the entity receiving the benefit of the Services, as applicable; and
  • You, or the entity on whose behalf you are acting, agree to be bound by these Terms of Use.

Non-Acceptance

If at any time you (or the entity on whose behalf you are acting) do not accept and agree to be bound by these Terms and our Privacy Policy, your sole recourse is to stop using the CA Auto Insight Reports Services immediately.

Eligibility

The CA Auto Insight Reports Services are available only to individuals who:

  • Are at least 18 years of age
  • Have achieved the age of majority in their jurisdiction
  • Are legally able to agree to these Terms and Conditions

You represent and warrant to CA Auto Insight Reports that all registration and other information you submit is accurate and truthful, and that you have the rights to provide such information to us.

Note: CA Auto Insight Reports may refuse to offer any service to any person or entity at any time for any reason. This provision is void where prohibited by law.

Territory

The CA Auto Insight Reports Services are intended for use globally and have no restriction for use in any territory.

Updates: CA Auto Insight Reports may change the territories at any time by updating these Terms and Conditions. The updated version posted on our website will serve as notice of such changes.

License

The CA Auto Insight Reports Service is licensed to you, not sold. Subject to your compliance with applicable laws and these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use our services.

Website Usage

Limited to learning about CA Auto Insight Reports and our services, and submitting inquiries to us through our standard interfaces.

Mobile Applications & Web Services

Limited to requesting and receiving vehicle history reports and other information provided by CA Auto Insight Reports.

Vehicle History & Valuation Reports

Limited to evaluating information about used cars that you:

  • Own, lease, or have an insurable interest in
  • Are considering marketing, trading, purchasing, or leasing
  • Need for insurance underwriting and claims processing

Affiliate Program

Limited to becoming an affiliate and benefiting from opportunities available through the CA Auto Insight Reports Affiliate Program.

License Revocation: We may revoke this license at any time with or without reason. The license will be automatically revoked immediately upon any breach of these Terms and Conditions.

Restrictions and Obligations

General Service Restrictions

You are responsible for all activities conducted while using any CA Auto InsightReports Service.

You agree NOT to:

  • Modify, copy, reproduce, publish, share, or distribute any service content
  • Sell, rent, lease, license, or transfer any service without written consent
  • Impersonate any person or entity
  • Use services to create competing products
  • Remove copyright notices or proprietary markings
  • Misrepresent your affiliation with any entity
  • Use services to collect or store content without authorization

You must ensure services remain secure from unauthorized access and comply with all applicable laws and industry standards.

Website & Software Restrictions

Additional restrictions apply to website and software use:

  • Do not upload content that infringes intellectual property rights
  • Do not post unlawful, threatening, or inappropriate content
  • Do not send unauthorized advertising or spam
  • Do not introduce viruses or malicious code
  • Do not disrupt service operations or networks
  • Do not bypass security measures
  • Do not use automated scripts or bots
  • Do not share login credentials
  • Do not reverse engineer or decompile software

We may suspend or terminate your access at any time for any reason.

Product Usage Restrictions

You may NOT:

  • Modify or adapt products for use by others
  • Reverse engineer algorithms or methodologies
  • Export, import, or transfer software outside the provided country

Vehicle History Report Restrictions

Specific limitations for vehicle reports:

  • Do not use for Fair Credit Reporting Act purposes (credit, employment)
  • Do not claim we warrant or certify vehicle quality
  • Only access reports for vehicles you have an insurable interest in

Software Updates

Software may automatically check for updates. You agree that CA Auto InsightReports may provide updates subject to these Terms.

Updates are subject to these Terms unless expressly provided under different written terms.

If you transition from a similar affiliate program, you consent to receiving relevant offers and notifications.

Proprietary Rights

CA Auto Insight Reports owns all rights to services, content, and materials

  • All intellectual property rights are reserved by CA Auto Insight Reports
  • You acquire no rights except limited usage rights as specified
  • Services are licensed, not sold to you
  • Third-party trademarks belong to their respective owners

You acknowledge that CA Auto Insight Reports expressly reserves all rights, title, and interest in the services, content, and all related materials.

Communications and Feedback

No Confidentiality Guarantee

CA Auto Insight Reports does not guarantee the confidentiality of any communications made by you. We may retain copies for legal, regulatory, or archival purposes.

Feedback Submission

By submitting feedback, you agree that:

  • Your feedback does not contain confidential information
  • We are under no obligation of confidentiality
  • You grant us a perpetual, worldwide, royalty-free license to use your feedback
  • We may already have similar ideas in development
  • You waive moral rights and assign all rights to us
  • You are not entitled to compensation
  • You have the rights to grant us this license

Electronic Communications Consent

You consent to receiving communications, newsletters, and alerts by email or text message, in compliance with CASL (Canada's Anti-Spam Legislation).

CA Auto Insight Reports has no responsibility for providing internet connectivity, wireless access, or telecommunications services necessary to use our services.

Fees and Payment

Payment Obligations

You agree to pay all fees invoiced for products, services, or software, either per transaction or subscription basis.

Retail Consumers

Pay fees upon delivery of vehicle history reports through the website.

Trial Periods

Free trials are time-limited and may be terminated at any time. You must notify us in writing if you don't wish to continue.

If we don't receive written notice to cancel, you will be billed full fees starting from the trial end date.

Confidentiality

Confidential Information Protection

You may access confidential information including market analyses, forecasts, pricing trends, and other proprietary data.

Your Confidentiality Obligations

  • Take all reasonable steps to maintain confidentiality
  • Do not disclose confidential information to third parties
  • Only share with employees who have a genuine need to know
  • Ensure employees are bound by written confidentiality agreements
  • Confidentiality obligations survive termination of these Terms

Legal Consequences

Breach of confidentiality causes irreparable damage. We are entitled to seek immediate injunctive relief without proving damages or posting security.

CA Auto Insight Reports services contain valuable trade secrets developed at considerable time and expense.

Termination and Suspension

Termination Rights

CA Auto Insight Reports may terminate your license and suspend services if you breach these Terms.

Service Suspension

  • We may temporarily suspend services for legal requirements
  • Suspension may occur for security violations or threats
  • Service maintenance or repair may require temporary suspension
  • We may suspend services for any necessary reasons

Upon termination, you must cease all service use and delete all copies of products or content.

Disclaimers

"As Is" Basis

Services are provided "as is" and "as available" without any warranties of any kind.

Warranty Disclaimers

  • No warranties of merchantability or fitness for particular purpose
  • No warranty of uninterrupted, error-free, or virus-free service
  • We may modify, improve, or discontinue services at any time
  • No obligation to store your feedback
  • Not suitable for mission-critical or hazardous environments

Legal Limitations

  • Claims must be brought within 30 days of cause of action
  • No liability for indirect, incidental, or consequential damages
  • You release us from claims against third parties
  • Limitations apply regardless of the legal theory
  • These limitations are essential to these Terms

Limitation of Liability

Liability Cap

Our maximum liability will not exceed the fees you paid for the specific service that gave rise to the claim, in the month the claim arose.

Refunds & Disputes

Vehicle History Reports

Refund Eligible

  • Unable to generate report due to data unavailability
  • Duplicate payments within 14 days
  • Report fails to generate and support can't deliver in 48 hours

No Refund

  • Substantially inaccurate or incomplete information
  • Once reports are generated and delivered

Window Stickers

Refund Scenarios

  • Technical issues preventing generation (unresolved in 48 hours)
  • Accidental duplicate purchases for same vehicle
  • Unable to provide accurate sticker after multiple revisions

Subscriptions

Refunds available within 7 days if no reports or stickers were generated.

Important Notes

  • Refund requests must be made within 7 days of purchase
  • Valid documentation required to support claims
  • Refunds processed within 7 days of approval
  • Generated reports and stickers are non-refundable

Defense and Indemnity

Your Indemnification Obligation

You agree to defend, indemnify, and hold harmless CA Auto Insight Reports from all claims and expenses arising from:

  • Your use of our services
  • Anyone using your login credentials
  • Any violation of these Terms and Conditions
  • Includes reasonable legal fees and expenses

Changes to Terms

We May Update These Terms

CA Auto Insight Reports reserves the right to change these Terms at any time by posting updated versions on our website.

Your Responsibilities

  • You are responsible for regularly reviewing these Terms
  • Check the "Last Update" date to stay informed of changes
  • Continued use after changes constitutes acceptance
  • Your only recourse if dissatisfied is to stop using our services

Additional Usage Rules

App Store Applications

Software downloaded from third-party app stores may be subject to additional usage rules.

Apple App Store

  • Terms are between you and CA Auto Insight Reports, not Apple
  • Apple has no liability for software performance
  • Apple is a third-party beneficiary for this section
  • License limited to Apple devices you own or control

Google Play Store

  • Terms are between you and CA Auto Insight Reports, not Google
  • Google has no liability for software performance
  • Google is a third-party beneficiary for this section
  • No maintenance or support obligations from Google

You warrant you are not located in embargoed countries or on restricted parties lists.

General Provisions

Assignment

  • We may assign this Agreement without notice or consent
  • You may not assign without our prior written consent
  • We may use contractors to perform our obligations

Notices

All notices to us must be:

  • In writing
  • Delivered in person, by courier, or registered mail
  • Addressed to: 2196 3rd Ave #4001 New York, NY 10035 United States

Force Majeure

We are not liable for failures due to:

  • Natural disasters
  • Acts of God
  • Labor disputes
  • War or terrorism
  • Government restrictions
  • Power failures
  • Internet outages
  • Hacker attacks

Entire Agreement

These Terms constitute the complete agreement and supersede all prior communications and agreements.

No Waiver

Failure to enforce any provision does not constitute a waiver. Waivers must be in writing.

Severability

If any provision is invalid, the remaining provisions continue in full force and effect.

Governing Law

Governed by Quebec law. Jurisdiction in Quebec courts. No jury trials or class actions.

Language

These Terms and Conditions are provided in English as expressly wished by both parties.
